Il giudice californiano D.D. Sitgraves ha rifiutato l’estradizione in Italia del boss mafioso Rosario Gambino, preoccupato per il fatto che il boss possa subire la "tortura" del carcere duro. Il giudice sostiene che il cosiddetto “41-bis” viola le norme ONU.
Una notizia "eclatante", reagisce il Ministro della Giustizia Clemente Mastella. "Francamente, che venga da un giudice di un paese come gli Stati Uniti, che applica la pena di morte ... Non so davvero se sia più in linea con le norme ONU chi applica la pena di morte o chi utilizza il carcere duro, vedi Guantanamo".
Fa eco il presidente della Commissione Antimafia, Francesco Forgione: "Da quale pulpito viene la predica ... Il 41-bis ha superato tutte le prove, da quella di costituzionalità a quelle dell’Onu, fino alla corte europea dei diritti dell’uomo". Tutto questo in un momento in cui gli USA sono nel mirino della comunità internazionale per le leggi speciali antiterrorismo approvate dopo l’11 settembre e, soprattutto, per le violazioni dei diritti umani nel carcere di Guantanamo. Tante denunce di questi detenuti e di altri presunti terroristi nelle carceri Usa fanno appunto appello alla convenzione dell’ONU contro la tortura. La stessa cui si riferisce il giudice Sitgraves parlando, però, dell’Italia.
Che gli USA siano un paese sorpendente lo sappiamo tutti. Ma questa è davvero bella …

California judge D.D. Sitgraves refused to extradite Rosario Gambino (a dangerous Mafia boss) to Italy, on the grounds of possible “torture” to which the Mafia boss might be subjected, owing to him being assigned to the “Code 41-bis” (a special law provision in force in Italy, according to which dangerous prisoners, such as Mafia bosses, terrorists, serial killers, etc. are subjected to hard imprisonment conditions). Judge D.D. Sitgraves says that “Code 41-bis” violates the ONU law on human rights.
“An astonishing piece of news,” says Italian Minister of Justice Clemente Mastella. “Quite more astonishing if we consider that such a statement on human rights comes from the USA, a country where the death penalty is enforced. Not to mention the REALLY HARD imprisonment conditions that exist in Guantanamo,” continues Clemente Mastella.
The Italian Minister of Justice’s words are echoed by Italy’s Antimafia Commitee President Francesco Forgione. “Look who’s talking … Code 41-bis has been approved and sanctioned both by the ONU and the European Court on Human Rights”. As a matter of fact, judge D.D. Sitgraves's statement really comes as a “surprise”: the USA government has been criticized by the international community for enforcing the special laws to fight terrorism, approved after September 11th 2001 and, above all, for violating the human rights in the Guantanamo prison. So many accusations from prisoners in Guantanamo and many other alleged terrorists in the USA prisons do appeal to the ONU convention against torture. The very same convention to which judge Sitgraves refers – the only difference in this case being that Italy is involved, not the USA.
Everybody knows the USA is a surprising country. Yet, this piece of news is a good one!
